GP FOR REVENUE THE HONOURABLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION No: 15961 of 2025 ORDER: Heard learned counsel for the petitioners and learned Government Pleader for Revenue for the respondents. 2. Though the petitioners made several allegations against the respondents, during hearing, learned counsel for the petitioners requested this Court, without touching the merits of the case, to issue a direction to the respondents to consider and the explanation dated 11.06.2025 submitted by the petitioners to the notice dated 09.06.2025. 3. On the other hand, learned Government Pleader for Revenue furnished written instructions dated 27.06.2025 issued by respondent No.3, wherein, the relevant portion of the said instructions is extracted hereunder: “It is further submitted that the Writ Petitioner counsel submitted the return explanation on 27.06.2025, it is under examination, in the mean while, the writ petitioner approach the Hon’ble Court filed this Writ Petition without availing statutory law as provided by the Act. Hence, it is humbly requested to appraise the above facts to the Hon’ble High Court and pray that the Writ Petition may be dismissed in the interest of justice and public interest.” 4. On perusal of the said instructions, it is evident that the explanation submitted by the petitioners is already under consideration and the same will be considered within a reasonable time. 5. In view of the submission of the learned Government Pleader for Revenue, this Court need not decide the truth or otherwise of the allegations made in the petition. This Court is conscious that no such direction be issued, in view of the judgment of the Apex Court in “The Government of India v. P.Venkatesh1”, wherein the Apex Court held that such orders may make for a quick or easy disposal of cases in overburdened adjudicatory institutions. But, they do not serve to the cause of justice. 6. In the result, with the consent of both the learned counsel, the writ petition is disposed of, directing the respondents to consider the explanation dated 11.06.2025 submitted by the petitioners, to the notice dated 09.06.2025 after providing opportunity of hearing to all the parties concerned, within a period of four (03) months from the date of receipt of a copy of this order. There shall be no order as to costs.
