It has been fairly submitted by learned counsel for the petitioner that the instant contempt petition arises out of an order/judgment dated 01.01.2025 passed by this Court in WP(C) No. 223/2022. It is further submitted that the said judgment has already been assailed by the JDA before the Hon’ble Division Bench in LPA No. 71/2025, and the Hon’ble Division Bench, vide order dated 15.04.2025 has been pleased to direct status-quo with regard to the strip of land in question, which order continues to remain operative as on date. 02. Learned counsel for the petitioner has further brought to the notice of this Court that the aforesaid order of status-quo is being flouted by the private respondent and, therefore, a fresh cause of action has accrued to the petitioner. In view of the same, learned counsel for the petitioner seeks withdrawal of the instant contempt petition with liberty to file fresh contempt petition seeking implementation of the aforesaid order passed by the Hon’ble Division Bench. 03. Accordingly, the proceedings in the instant contempt petition are closed. Rule, if any, shall stand discharged. However, dismissal of the instant contempt Sr. No. 18 2 | P a g e CCP(S) No. 124/2025 IN WP(C) No. 222/2022 petition shall not come in the way of the petitioner in filing a fresh contempt petition, in case the aforesaid order passed by the Hon’ble Division Bench is found to be violated, as submitted by learned counsel for the petitioner. 04.
