ORDER
Heard Sri K.H.V.Siva Kumar, learned counsel for the petitioner, Sri K.Narsi Reddy, learned counsel for 1st respondent and Sri P.Subash,
learned counsel for respondents 2 & 3. 2. The above contempt case is filed complaining non-implementation of the order dated 11.11.2019 in W.P.No.13460 of 2019. 3. The petitioner filed the aforementioned writ petition to declare the action of respondents in laying a road in the petitioner’s private land of an extent of Ac.0.54 cents in S.No.327-6 of Arumbaka village, Cherukupalli Mandal, Guntur District, as illegal and arbitrary. 4. The said writ petition was disposed of on 11.11.2019 and the operative portion of the order reads thus:
“3. Having regard to the above submission, this Writ Petition is disposed of directing the respondents 5 & 6 to consider the online application of petitioner dated 03.06.2019 and conduct survey in respect of the petitioner’s land admeasuring Ac.0.54 cents, out of Ac.1.00 cents, in S.No.327-6 of Arumbaka Village, Cherukupalli Mandal, Guntur District, in the presence of petitioner as well as fourth respondent by giving prior notice to them.”
5. In the affidavit filed in support of the contempt case, it was pleaded that the order dated 11.11.2019 in W.P.No.13460 of 2019 is not complied with. In Paragraph-3 of the affidavit, it was pleaded that the 3rd respondent/Mandal Surveyor obtained the petitioner’s signature on a letter prepared by him and gave copy of plan countersigned by the 2nd respondent/Tahsildar. The 3rd respondent/surveyor did not note the gravel road margin of the said black tar road etc. 6. A counter affidavit was filed by the 2nd respondent. It was pleaded that in pursuance of the order passed by this Court, the survey was conducted on 09.01.2020 in the presence of D.E.E, R&B Sub-Division, Tenali, A.E, R&B Section, Amarthalur, Village Revenue Officer, Amarthalur as well as the petitioner. The survey was concluded on
09.01.2020. Thereafter the R&B officials absented to attend the survey for two consecutive days. In the presence of the petitioner and the
V.R.O, the unfinished survey was completed by the Mandal Surveyor. The petitioner personally verified the survey. Along with counter affidavit, the report communicated to the R&B officials was filed. 7. No rejoined was filed by the petitioner. 8. Thus, as seen from the averments in the counter affidavit, in pursuance of the order dated 11.11.2019 in W.P.No.13460 of 2019, survey was conducted on 09.01.2020. Hence, this Court does not find any violation of the order by the respondent. 9. Accordingly, the Contempt Case is Closed. No costs.
