1. Heard Mr. S. M. Abdullah P, the learned counsel for the petitioner. Also heard Mr. R. J. Baruah, the learned Additional Public Prosecutor for the State respondent.
2. The learned Additional Public Prosecutor has submitted that though,
Page No.# 2/2 the requisitions were sent for the case diary on several occasions, however, the same has not been sent.
3. It appears that this is an old pending anticipatory bail application of the year 2023, it also appears that the petitioner, namely, Mantaz Ali was granted interim bail by this Court by order dated 22.12.2023 with certain conditions.
4. The learned Additional Public Prosecutor also submits that since initially this case was registered under Hazo Police Station and later on, it was transferred to Dispur Police Station and in-spite of several requisitions being sent to the Investigating Officer, the case diary has not been received.
5. The learned counsel for the petitioner has submitted that in pursuant to the directions of this Court, the petitioner has appeared before the Investigating Officer and has co-operated in the investigation.
6. Since, this is a very old pending case and in-spite of repeated requisitions, the prosecution side has unable to produce the case diary and since, the petitioner has complied with the direction of this Court and have cooperated in the investigation, the interim bail granted to the petitioner by
order dated 22.12.2023 is hereby made absolute with the condition Nos. 2 and 3 of the said order remaining intact.
7. With the above observations, this anticipatory bail application is
disposed of.
