Heard Sri Shashi Kala Singh learned counsel for the petitioner, Sri Anand Bhaskar Srivastava, learned Standing Counsel appearing for the State-respondents. The present petition has been filed seeking a direction to respondent no. 3, the Sub Divisional Magistrate, Azamgarh, to take a decision on an application dated 30.11.2023 stated to have been submitted by the petitioner, and also for a direction to the respondent no.2, the District Magistrate, Azamgarh to decide the representation of the petitioner dated 11.08.2023, within a stipulated time period. It is not disputed by the counsel for the petitioner that the reliefs sought in the writ petition would involve adjudication of disputed questions of fact relating to rights and title of the parties, in respect of an immovable property being a land parcel and the same would be beyond the scope of administrative powers to be exercised by the concerned respondent authorities. Accordingly, learned counsel for the petitioner states that he does not wish to press the petition and that the petitioner would avail the appropriate legal remedy, in regard to his grievances.
