Lekh Ram Vs. Payal Behal CMP No. 15064/2025 in COPC No. 239/2015 21.04.2026 Present: Mr. Rakesh Thakur, Advocate, for the petitioner. Mr. Anuj Bali, Advocate for respondent No.1. Mr. L.N. Sharma, Mr. Y.P.S. Dhaulta, Additional Advocate General, for the respondents/State. CMP No. 15064/2025 This application has been moved for revival of the contempt petition bearing COPC No. 239/2015. The contempt petition was otherwise decided on 04.12.2024 as under: - “While placing on record communication dated 02.12.2024, which appears to have been addressed to Manager, State Bank of India, Shimla East by H.P. State Council for Child Welfare Craig Garden, Shimla, Mr. Anuj Bali, learned counsel representing the respondent-Council states that sum of Rs.6,66,992/- on account of interest stands credited in the Bank account of the petitioner and as such, nothing remains to be adjudicated in the instant proceedings. 2. Mr. Sanjeev Bhushan, learned Senior Counsel representing the petitioner while fairly admitting receipt of aforesaid amount states that yet some amount is required to be paid on account of interest. 3. Be that as it may, having taken note of aforesaid deposit made by respondent-Council, coupled with the fact that principal amount already stands paid to the petitioner, nothing remains to be adjudicated in the instant proceedings and accordingly the same are closed. Notices issued to respondents are discharged. However, liberty is reserved to the petitioner to file appropriate proceedings in appropriate Court of law, qua the surviving grievance, if required and desired.” 2. It appears that there is certain dispute regarding the amount that remains due to the petitioner, as alleged by him, though the said fact is not admitted by the respondents. In the given scenario, this application is disposed of with liberty reserved to the petitioner to seek appropriate remedy, in accordance with law, for the redressal of his surviving grievance, if any.
