Case No. 47 of 2023 for the offences registered under section 376(DA) of the Indian Penal Code and section 6 of POCSO Act, pending in the court of learned Exclusive Special Judge, POCSO- cum-Additional Sessions Judge-IV, Gumla. 3. Petitioner along with co-accused persons have gangraped three victims. 4. Statement of the victims has been recorded under section 164 of the Cr. P.C. in which they have supported the allegation. 5. Mr. Mohit Prakash, learned counsel appearing on behalf of the petitioner, submitted that the victims have been examined and they have not stated anything about the petitioner. 6. Considering the fact that there is direct allegation against the petitioner in the FIR that he had participated in the gangrape of three victims and the trial is under progress, I am not inclined to release the petitioner on bail.
