Colont, Ananthapuram Disrict, ...Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of respondents, particularly respondents 3 and 4 in repeatedly insisting me to appear before their authority and threatening to arrest me, If I do not yield to the terms of Respondents 5 to 7, under the guise of Implication of me in false case, as illegal, irregular, irrational and violative of articles 14 and 21 of Constitution of India and consequently direct the respondents not to interfere in any manner with my personal life, liberty and properties and to pass such IA NO: 1 OF 2020 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the respondents particularly Respondents 3 and 4 not to insist me to appear before their authority for settlement of claims of respondents 5 to 7 under the guise of implication of me in false case, pending disposal of main Writ Petition pending disposal of the above writ petition and to pass such Counsel for the Petitioner: NAGESWARA RAO V Counsel for the Respondents: GP FOR HOME The Court made the following order: THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 20989 OF 2020 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “....pleased to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondent No.2 in calling the petitioner and his family members to Police Station and interfering in civil disputes relating to the suit property of 0.S.No.156 of 2017 on the file of the Senior Civil Judge, Tadepalligudem, West Godavari and threatening the petitioner with false cases including S.Cs and S.Ts (POA) Act, 1989 through the Respondent No 5 if not compromise with Respondent No.3 to 5, as illegal, unjust, unfair, in violation of principles of natural justice, violative of the Fundamental Right guaranteed under Articles 14 and the Constitutional Right guaranteed under Constitution of India and consequently direct the Respondent No.2 not to interfere in civil disputes of property admeasuring Ac,5-28 Cei6 in R.S.No.326/1 and and Ac.1-50 Cents out of Ac.2-12 in R.S,No,121/2B situated at Veerampalem village, Tadepalligudem, West Godavari and pass..” 2. Heard Sri Veerapu Nageswara Rao, learned counsel for the petitioners and Sri Md.Farooq, learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioner would submit that the police are interfering in the civil dispute and calling the petitioners to the police station. 4. Sri V.Farook, learned Assistant Government Pleader for Home, would submit that in the light of the interim orders dated 10.11.2020, no further orders are required to be passed in this matter. 5. As can be seen from the interim order dated 10.11.2020, this Court directed the respondent Nos.1 to 4 not to call the petitioner to the police station in connection with the civil dispute between the petitioner and respondent Nos.5 to 7 relating to recovery of money on the foot of a promissory note. 6. In that view, this writ petition is disposed of. There shall be no order as to costs.
