Hon’ble Mr. Justice Amitendra Kishore Prasad Order on Board 09/05/2025 1. By way of this petition, the petitioner has prayed for following reliefs:- “10.1 The Hon'ble Court may kindly be pleased to Digitally signed by RAGHVENDRA JAT 2 issue a writ of mandamus directing the Respondent No. 02 to credit the interest amount in the savings account of the Petitioner having no. 20062018417. 10.2 The Hon'ble Court may kindly be pleased to issue a writ, directing to the Respondents to deposit the principal amount of FD in Petitioner's savings account having account no. 20062018417 once the FD gets mature on 15/05/2025. 10.3 Any other relief/reliefs which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case with cost of the petition may also be granted, in the interest of justice. Incumbent” 2. Learned counsel for the petitioner submits that he is challenging the wrongful inaction of the respondent No.1 whereby respondent No. 01 is crediting the quarterly interest amount to the Joint Account of the Petitioner and Respondent No. 02 having Account No. 20062018417, arising out of the fixed deposit amounting of the Rs. 25,00,000/- which Petitioner has deposited on 15/05/2023 in the Hospital Brach of State Bank of India (Respondent No. 01) as a fixed deposit for the period of 2 years having FD Account No. 41918459548. It is pertinent to mention here that despite the several requests made by the Petitioner to the Respondent No. 01 to credit the interest amount to the other 3 savings account of the Petitioner having Account No. 30486958444 and also to deposit the FD amount of Rs. 25,00,000/- to the savings account of the Petitioner once it gets matured on 15/05/2025, having, the Respondent No. 01 has not considered the requests of the Petitioner and continued to deposit the amount to the joint Account of the Petitioner and the Respondent No. 02 having Account No. 20062018417, which amounts to the unfair banking practice to disregard the lawful demand of the account holder. Hence the Petition. 3. On the other hand, learned counsel for respondent No. 1 opposes the same. 4. I have heard learned counsel for the parties and perused the material available on record. 5. Considering the facts and circumstances of the case, the application filed by the petitioner be considered by the bank and necessary orders may be passed by the concerned Bank. 6. With this observation, the writ petition is disposed of. SD/- (Amitendra Kishore Prasad) Judge Raghu Jat
