Heard Mr. Brajesh Shukla, learned counsel for the petitioner, Mr. Ayub Khan, learned counsel for respondent no.4 and Mr. Ajay Kumar Baranwal, learned Standing Counsel for the State-respondents. 2. Brief facts of the case are that time barred title objection filed under Section 9-A (2) of U.P. Consolidation of Holdings Act, 1953 (hereinafter referred to as "U.P.C.H. Act") to declare the plot no.2192 and 2354 as C.H.18 was dismissed on the ground of limitation as well as merit vide order dated 20.12.2021. Against the order of Consolidation Officer, appeal under Section 11 (1) of U.P.C.H. Act filed by the petitioner was allowed and matter was remitted back before Consolidation Officer to decide the proceeding under section - 9A(2) of U.P.C.H. Act afresh by the Settlement Officer of Consolidation vide order dated 26.4.2022. Title revision filed on behalf of petitioner has been allowed by the Additional District Magistrate (Finance & Revenue)/ Deputy Director of Consolidation vide order dated 17.1.2023 setting aside the appellate order 26.4.2022. Hence this writ petition for the following relief: "issue a writ, order or direction in the nature of certiorari to quash the order dated 17.1.2023 passed by Deputy Director of Consolidation / Additional District Magistrate Bagpat in Revision No.0016 of 2023, Computer Case No.20235411800000016 (Ram Veer vs. Krishnapal)." 3. Learned counsel for the petitioner submitted that the impugned revisional order has been passed by the Deputy Director of Consolidation in illegal and arbitrary manner without considering the case of the petitioner as setup before the authorities. He further submitted that proceeding under Section 9-A(2) of the U.P.C.H. Act along with prayer for Condonation of delay has been initiated in proper manner, as such, the same should be decided on merit rather on the technical consideration. He further submitted that the impugned order should be set aside and the proceeding under Section 9-A (2) of U.P.C.H. Act should be decided on merit by Consolidation Officer. 4. On the other hand, Mr. Ayub Khan, learned counsel for respondent no.4 submitted that finding of fact has been recorded by Deputy Director of Consolidation holding that the petitioner has no locus to initiate the proceeding. He further submitted that the filing of title objection at the very late stage cannot be entertained. He further submitted that no interference is required and writ petition is liable to be dismissed. 5. I have considered the argument advanced by learned counsel for the parties and perused the records. 6. There is no dispute about the fact that the time barred proceeding under Section 9-A (2) of U.P.C.H. Act initiated by the petitioner was dismissed by the Consolidation Officer but in appeal the matter was rightly remanded back before Consolidation Officer for fresh decision afresh. There is also no dispute about the fact that revision under Section 48 of U.P.C.H. Act filed by respondent no.4 has been allowed and appellate order dated 26.4.2022 has been set aside. 7. In order to appreciate the controversy involved in the matter, perusal of relevant finding of fact recorded by Deputy Director of Consolidation will be necessary, which is as under: " नययययलयय उप ससचयलक चकबनदद मणडलय ममरठ, जनपदयबयगपत, तहसदलय बडडत वयद ससखययय-0016/2023 कस पययटरदकक त वयद ससखययय-20235411800000016 रयमबदर बनयम कक षणपयल असतगरत धयरययय 48(1), अधधननयमय - उ०प० जजत चकबनदद अधधननयम , 1953 मडजय बयमनडलद परगनय बरनयवय तहसदल बडडत ममरम दयरय पतयवलद एवस पतयवलद पर उपलबध सयकयय एवस ससबसधधत अनभलमखय कज अवलजकन नकयय गयय। अवलजकन सम सपष हह नक कक षणपयल पपत शयनय दयरय कयलबयधधत वयद बयवत गयटय ससखयय-2192 एवस 2354 कज चकबनदद पकथक नकयम जयनम हमतप चकबनदद अधधकयरद नययययलय मम यजधजत कक गयद। धजसपर नययय- ननणरय करतम हहयम चकबनदद अधधकयरद दयरय नदनयसक 20.12.2021 कज वयद कज कयलबयधधत एवस बलहदन हजनम कम कयरण ननरसत कर नदयय गयय। उक आदमश कम नवरद शद कक षणपयल दयरय अपदलदय नययययलय मम अपदल यजधजत कक गयद, धजसम अपदलदय नययययलय दयरय नदनयसक 26.04.2022 कज सवदकयर करतम हहयम चकबनदद अधधकयरद दयरय पयररत आदमश नदनयसक 20.12.2021 कज ननरसत कर वयद कज चकबनदद अधधकयरद नययययलय मम पपनय सपनवयई हमतप पतययवनतरत नकयय गयय हह। गयटय ससखयय-2192 एवस 2354 कय रकबय चकबनदद पनकयय दडरयन अनय कक षकय कम चकय मम पसतयनवत नकयय गयय हह, धजसकम नवरद शद कक षणपयल दयरय कभद कजई वयद अथवय आपधत नकसद भद सकम नययययलय मम यजधजत कक गयद हज, ऐसय कजई सयकय उपलबध नहह हह। धजससम सपष हजतय हह नक शद कक षणपयल अपनम पसतयनवत चक सम ससतपष रहय हह। गयम बयमनडलद कय पपनषकरण वषर 2009 मम हज चपकय हह एवस गयम बयमनडलद कय कबजय पररवतरन वषर 2016 मम पयणर हज चपकय हह। समसत कक षकगण अपनद नयम पसतयनवत चकज पर कयनबज हह। पशनगत वयद मम नवपकद कक षणपयल दयरय गयम कम पपनषकरण कम लगभग 12 वषर एवस कबजय पररवतरन कम 05 वषर बयद नययययलय चकबनदद अधधकयरद मम वयद यजधजत नकयय गयय हह। ननगरयनद सपनवयई दडरयन यह भद तथय ससजयन मम आयय हह नक शद कक षणपयल दयरय अपनद समसत भयनम कज नवकय कर नदयय गयय हह। वयद सम ससबसधधत भयनम कज नवकय करनम कम बयद नवपकद कक षणपयल दयरय इस भयनम कम समबनध मम नकसद पकयर कक कजई मयसग नकयय जयनय उनचत नहह हह। यह भद उलमखनदय हह नक उतर पदमश जजत चकबनदद अधधननयम, 1953 कक धयरय-11 मम सपष उलमख हह नक नकसद भद ऐसम पशन कज जज धयरय-9 क कम अधदन उठययय गयय हज यय उक धयरय कम अधदन उठययय जय सकतय थय यय उठययय जयनय चयनहए थय, परनतप उठययय नहह गयय हह। चकबनदद कययरवयनहयय कक नकसद वयद कक अवसथय मम न तज उठययय जययमगय और न हद उसकक सपनवयई कक जययमगद। गयम बयमनडलद कय पपनषकरण वषर 2009 मम हज चपकय हह एवस गयम कय कबजय पररवतरन वषर 2016 मम हज चपकय हह। चकबनदद अधधकयरद दयरय चकबनदद ननयमयवलद कज दनषगत रखतम हहयम नदनयसक 20.12.2021 कज ननयमयनपसयर आदमश पयररत नकयय गयय हह, नकनतप अपदलदय नययययलय दयरय नबनय नकसद पययरप कयरण कम पभयनवत पकय कज सपनवयई कय अवसर नदयम बगहर तथय नबनय सथल ननरदकण नकयम तथय इस तथय कय परदकण नकयम बगहर, नक अपदलयथर कक मयसग कय आधयर उनचत हह अथवय नहह। आदमश नदनयसक 20.12.2021 कज ननरसत करतम हहयम अपदल मम नदनयसक 26.04.2022 कज नवधध- नवरद आदमश पयररत नकयय गयय हह। गयम कम अनभलमखय कम अवलजकन सम यह भद सपष हह नक नवपकद कक षणपयल कक मयसग सम ससबसधधत गयटय ससखयय- 2192 सम ससबसध मम पशनगत गयटम कम सममपख जजत चकबनदद आकयर पत-2 क मम चकबनदद अधधकयरद कम वयद ससखयय-50 कय इनदयज असनकत हह, जज ससबसधधत चकबनदद लमखपयल दयरय वषर 2017 मम असनकत नकयय गयय हह, धजसकम दयरय पशनगत गयटम कम नवननमय अनपपयत मम पररवतरन नकयय गयय हह। इस पकयर चकबनदद अधधकयरद पशनगत आदमश जदनवत रहतम वतरमयन मम पपनय नवपकद कक षणपयल कक मयसग पर उक गयटम कम समबनध मम कजई पररवतरन नकयय जयनय उनचत नहह हह। वतरमयन मम यनद नवपकद चयहम तज अपनम पसतयनवत चक मम पररवतरन हमतप सकम नययययलय मम वयद यजधजत कर अनपतजष पयप कर सकतय हह। उपरजक कयरणय सम सपष हह नक अपदलदय नययययलय दयरय ससबसधधत अनभलमखय एवस तथयय कय गहनतय सम अवलजकन नकयम बगहर हद नदनयसक 26.04.2022 कज आदमश पयररत नकयय गयय हह, जज ससथर रहनम यजगय नहह हह। अतय आदमश हहआ नकय- आदमश उपरजक नववमचनय कम आधयर पर शद रयमवदर पपत उमरयव ननवयसद गयम बयमनडलद परगनय बरनयवय तहसदल बडडत धजलय बयगपत दयरय पसतपत ननगरयनद सवदकयर कक जयतद हह। नययययलय बनदजबसत अधधकयरद चकबनदद, बयगपत कक अपदल ससखयय- 33 अनतगरत धयरय-11 (1) जजत चकबनदद अधधननयम मम पयररत आदमश नदनयसक 26.04.2022 नवधध- नवरद हजनम कम कयरण ननरसत नकयय जयतय हह। पतयवलद बयद आवशयक कययरवयहद दयधखल दफतर हज। नदनयसक- 17.1.23 अपर धजलयधधकयरद (नव/रज०)/ उप ससचयलक चकबनदद, बयगपत।" 8. Considering the finding of fact recorded by Deputy Director of Consolidation, there is no scope of interference by this Court against the impugned order passed by the consolidation authorities in the proceedings under Section 9-A (2) of U.P.C.H. Act. 9. The writ petition is dismissed with observation that the pending chak revision shall be decided in accordance with law by the consolidation authority as observed in the impugned revisional order dated 17.1.2023.
