PUBLIC PROSECUTOR Respondent/complainant(S); The Court made the following Order: Learned counsel for the petitioners submits that the petitioners arrayed as accused in Crime No.9 of 2025 of Anaparthi Police Station, East Godavari district, for alleged offences under Sections 336(2), 336(3), 335, 338, 318(4) read with 3(5) of BNS. It is submitted that the 2"^^ respondent has filed a complaint alleging that a document which was registered in the year 1971 was shown as link document for registering the settlement deed in the year 2024. As seen from the complaint, it is stated that the 2""* respondent has obtained the information from Right to Information Act with regard to the existence of the link document which was registered as Document No.7576 of ^ 1971 and that the 2"^^ respondent had received the information from the office ^ of the Sub-Registrar that the last document which was registered with the Sub-Registrar’s office, Visakhapatnam was numbered as 6913 of 1971. Learned counsel for the petitioners submits that the petitioner had obtained encumbrance certificate of the property and that would categorically reveal the details of the documents registered over the property and that the document bearing No.7576 of 1971 is reflecting encumbrance certificate issued by the Joint Sub-Registrar. It is submitted that civil suit is pending challenging the validity of the settlement deed vide O.S.No.376 of 2024 on the file of VII Additional Junior Civil Judge, Visakhapatnam. Heard learned counsel for the petitioners and learned Assistant Public Prosecutor appearing for the State. Perused the material on record. are i I 2. 3. 4.
