Page No.# 3/3 Mr. R.R. Gogoi, learned Standing Counsel, PHE Department, Assam, is present on behalf of the official respondents. Mr. B. Islam, learned counsel for the respondent nos. 9 & 10 submits that the respondent no. 9 has retired from service on attaining the age of superannuation on 31/01/2023 whereas, the respondent no. 10 is on the verge of retirement and will retire from service on 31/05/2025. It appears that by filing this writ petition, the order dated 29/03/2018, by means of which, the respondent nos. 9 and 10 were promoted, has been put under challenge. Since the petitioners’ counsel is absent today and considering the nature of relief prayed for, this Court is of the opinion that the petitioners are no longer interested in pursuing the relief prayed for in the writ petition before the Court. As such, the writ petition stands dismissed for non- prosecution.
