This Court on 04.02.2025, directed Principal District and Session Judge, Chittoor and Station House Officer, Renigunta Police Station, Tirupati District to submit a report about status of C.C.No.6 of 2001. 3. Pursuant to the directions given, the learned I Additional District and Sessions Judge FAC Principle District Judge, Chittoor forwarded the letters addressed by the III Additional Civil Judge (Junior Division), Tirupati vide Dis.No.147 dated 12.02.2025 and letter Dis.No.107 dated 12.02.2025 forwarded by the V Additional Civil Judge (Junior Division)-cum- Additional Judicial Magistrate of First Class, Tirupati, Chittoor District. 4. The learned III Additional Civil Judge (Junior Division), Tirupati submitted that C.C.No.6 of 2001 in Crime No.287 of 1999 of Renigunta Police Station, which was pending on its file was transferred to V Additional Judicial Magistrate of First Class and the same was re-registered as C.C.No.398 of 2012, on the file of V Additional Judicial Magistrate of First Class, Tirupati. 5. The learned V Additional Judicial Magistrate of First Class, Tirupati submitted that A1 to A4 in the crime were reported died and the case against 3 Dr.YLR, J Crl.R.C.No.1719 of 2008 Dated 18.02.2025 them was abated; after full fledged trial, C.C No.398 of 2012 (6 of 2001) was disposed on 13.05.2022 by acquitting A2, A3, and A5 to A11. 6. Further, SHO, Renigunta Police Station vide letter dated 15.02.2025, also submitted that the Judgment was pronounced in the C.C No.6 of 2001 and the surviving accused therein were not found guilty and acquitted for the offence under Section 55 of Andhra Pradesh Forest Act, 1967 and Section 167 and 417 IPC and they are acquitted for the said offence under Section 255 (1) of Cr.P.C 7. The revision was filed challenging order dated 27.08.2008 in C.C No.6 of 2001 wherein the learned Magistrate, eschewed the evidence of PW1 as he did not turn up to the Court for several time and Non-Bailable Warrant was also issued. 8. In view of the letter submitted by the I Additional District Judge (FAC) Principal District Judge and III Additional Civil Judge (Junior Division), Tirupati and V Additional Judicial Magistrate of First Class, Tirupati, stating that the CC itself was disposed and the revision case is rendered infructuous. This Court deems it fit to dismiss the revision as infructuous. 9. Accordingly, the Criminal Revision Case is dismissed as infructuous.
