The suit instituted by plaintiff respondents was decided ex parte, against which a recall application under Order IX Rule 13 CPC was moved which is pending consideration since the year 2022. 2. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed off, at the admission stage, without calling for counter affidavit or issuing notice to private respondent, with a direction upon Civil Judge (Senior Division), Azamgarh to decide the restoration application registered as 23Ga2 in Case No. 37 of 2022, in accordance with law, after hearing all affected parties, preferably within a period of four months from the date of production of certified copy of this order. 3. With the aforesaid directions, writ petition stands disposed off. 4. It is made clear that this Court has not adjudicated the matter on merits.
