The prayer sought for herein is for a writ of mandamus to direct the third respondent to take necessary action on the report submitted by the second respondent vide letter No.Na.Ka.No.B46042/2024 dated 14.11.2024 within a reasonable time as fixed by this Court. 2. In Survey No.53 at Kezhnachipattu Village, Tiruvannamalai District, State Highways between Cuddalore and Chittoor and in the Highways poramboke, there has been an encroachment of nearly about twelve persons including the fourth respondent. 3. Despite the request having been made by the second respondent / Tahsildar, no action seems to have been taken by the third respondent, therefore, the petitioner has moved the present writ petition. 4.
Heard Mr.P.Arumugavel, learned counsel appearing for the petitioner and Mr.E.Vijay Anand, learned Additional Government Pleader appearing for the respondents 1 to 3. Notice to the fourth respondent is dispensed with in view of the order that is going to be passed in this writ petition. 5. If it is a Highways poramboke land where there has been an encroachment, it shall be earmarked and removed after conducting survey by giving proper notice to those encroachers either under the provisions of the Tamil Nadu Highways Act, 2001 if it is the State Highways or under the National Highways Act, 1956. However, it is the stand of the second respondent / Tahsildar that such encroachment removal can be undertaken under the provisions of the Tamil Nadu Land Encroachment Act, 1905, that has been 4/8 https://www.mhc.tn.gov.in/judis

In that view of the matter, this Court is inclined to dispose of the writ petition with the following orders: (i) that there shall be a direction to the respondents 2 & 3 to have a joint inspection and survey of the land in question to verify the alleged encroachment of the twelve persons including the fourth respondent and if they find the encroachment, the same can be removed after giving notice to those encroachers either under the Tamil Nadu Land Encroachment Act, 1905 or any legistation governing the land in question where the alleged encroachment has been made, in accordance with law. (ii) Such an exercise shall be undertaken jointly by the respondents 2 & 3 within a period of two months from the date of receipt of a copy of this order. 7.
