This is the first bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sahita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 06/2025 registered at Police Station – Torwa, District Bilaspur (C.G.), for the offence punishable under Sections 76, 333 and 351(2) of the Bhartiya Nyaya Sanhita, 2023. 2

As per story of the Prosecution, prosecutrix/victim has lodged an FIR on 02.01.2024 at Police Station Torwa, District Bilaspur stating therein that accused unlawfully entered in her house without permission and he forcibly assaulted her and when the victim resisted, he threatened to kill her if she reported the matter to anyone. The incident has caused the victim and her family to live in fear for their safety. 3. Learned counsel for the applicant would submit that the present applicant is an innocent person and he has been falsely implicated in the present case. She would further submit that there is no any independent witness in the present case and the victim has also not opposed the bail application filed by the present applicant before the learned Court below. Learned counsel further submitted that the applicant is in jail since 03.01.2025, conclusion of the trial may take some time, therefore, she prays for grant of regular bail to the applicant. 4. On the other hand, the learned Panel Lawyer opposes the bail application and submits that the charge-sheet has been filed in the present case before the competent Court. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case and further the the fact that allegation against the applicant is that he entered into the house of victim/prosecutrix, who is an unmarried woman
3 and molested her and threatened to kill her.
It transpires from the impugned order dated 20.01.2025 that he has already been convicted for the offence punishable under Sections 363, 366, 376 of the IPC and Section 4 of the Protection of Children From Sexual Offences Act, 2012 Act and has been sentenced for maximum period of 05 years R.I., which he has already served. In view of the same, I am not inclined to allow the same. 7. Accordingly, the bail application of the applicant – Pardeep Sonwan, involved in Crime No. 06/2025 registered at Police Station - Torwa, District Bilaspur (C.G.), for the offence punishable under Sections 76, 333 and 351(2) of the Bhartiya Nyaya Sanhita, 2023, is rejected. 8. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. - Sd/-
