Side) ******* 1/4 https://www.mhc.tn.gov.in/judis Crl.O.P.No.30614 of 2025 ORDER The petitioner herein, who was arrested and remanded to judicial custody on 14.03.2025 for the offences punishable under Sections 331(4) and 305(a) of BNS in Crime No.41 of 2025, registered on the file of the respondent police, seeks bail. 2. The allegation against the petitioner is that, the petitioner joined hands with other accused, broke open the defacto complainant's house and committed theft of 39 sovereigns of gold jewels, two silver Kamatchi lamps, a laptop and cash. Hence, this case. 3. The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 14.03.2025; and that the petitioner is ready to abide by any condition that may be imposed by this Court and sought for bail to the petitioner. 4. The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the bail to the petitioner reiterated the 2/4 https://www.mhc.tn.gov.in/judis Crl.O.P.No.30614 of 2025 prosecution case and submitted that there are two accused involved in this case and the petitioner is arrayed as A1; that the petitioner has five previous cases; that so far 18.5 sovereigns of gold jewels and a cash of Rs.4,00,000/- were recovered; and that the major part of the investigation has been completed. 5. Considering the submissions made on both sides, grave nature of offence, the previous antecedents of the petitioner, taking note of the fact that still huge amount and stolen gold jewels are yet to be recovered and if the petitioner is enlarged on bail, he would indulge in similar offence, hence this Court is not inclined to grant bail to the petitioner. 6.
