Also heard Mr. I. Borthakur, learned Standing Counsel, Forest Department for the respondent. This is an application under Section 482 of BNSS, 2023 praying for grant Page No.# 2/3 of pre-arrest bail to the accused/petitioner, who is apprehending arrest in connection with Range Forest Office, Rani Range Memo No. R/Notice/2024/867, under Sections 40 & 41 of the Assam Forest Regulation, 1891, dated 16.12.2024. Case Diary has been received. Perused the same. Heard both sides. It is submitted by Mr. Baruah, learned counsel for the petitioner, that the present accused/petitioner is innocent and he has not committed any such offence as alleged in the F.I.R. However, after obtaining the order of interim pre- arrest bail on 03.01.2025, he had already appeared before the Investigating Officer and co-operated in the investigation of this case. His statement under Section 161 Cr.P.C. has already been recorded and he is still ready and willing to co-operate in the further investigation of this case. Mr. Borthakur, learned Standing Counsel, Forest Department, submitted in this regard that the present petitioner had already co-operated in the investigation of this case and considering the materials available in the Case Diary, his pre-arrest bail prayer may be considered. After hearing the submissions made by the learned counsels of both sides and also considering the entire aspects of the case, nature of allegation as well as the conduct of the accused/petitioner, I find it a fit case to extend the privilege of pre-arrest bail to the accused/petitioner. Accordingly, the interim pre-arrest bail order, granted to the accused/petitioner vide order dated 03.01.2025, in respect of Case No. R-30/2024-2025, is hereby made absolute in the same terms and conditions.
