GP FOR HOME THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 21010 of 2020 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…pleased to issue a writ, or order or direction more particularly one in the nature of writ of mandamus declaring inaction of the respondents in considering the report dated 02- 03-2020 and not investigating allegations as per provisions of criminal procedure code as illegal, arbitrary and opposed to article 14 of the constitution of India and pass.…” 2. Heard Sri B. Srinivasa Rao, learned counsel for the petitioner and Sri V. Farooq, learned Assistant Government Pleader for Home for the respondents. 3. Learned Assistant Government Pleader for Home, on written instructions would submit that based on the report lodged by respondent No.4, a case in Cr.No.131 of 2019 under Section 174 of Cr.P.C (suspicious death) was registered. During the course of investigation, it came to light that there are property disputes between the petitioner and her daughter-in- law/respondent No.4. Subsequently, a report was submitted to the Superintendent of Police, Krishna District at Machilipatnam on the basis of a Spandana Petition filed by the petitioner. 4. Learned counsel for the petitioner would submit that appropriate orders may be passed. 5. Recording the above said submissions, the Writ Petition is disposed of. However, the petitioner is at liberty to workout her remedy before the appropriate forum according to law. There shall be no order as to costs.
