Kalita, learned counsel for the applicant. Also heard Mr. K. K. Deka, learned counsel appearing for the respondent No. 1. 2. The learned counsel for the applicant submits that the connected appeal has been filed by the Insurance Company mainly challenging the quantum of compensation awarded to the claimant and since the claimant has appeared in this interlocutory application, notice to the driver and the owner of the offending vehicle may be waived. 3. The learned counsel for the respondent No. 1 does not oppose the said prayer, hence the prayer is allowed. He also does not oppose the prayer for condonation of delay, since the delay is only of 21 days. 4. I have considered the submissions made by learned counsel for both the parties. 5. Considering their submissions as well as the reasons shown in the instant application, which caused the delay in filing of the connected appeal by the Insurance Company to be sufficient cause, the delay of 21 days in filing the connected appeal is hereby condoned. 6. The Registry is directed to register the connected MAC appeal and list it for admission on 4th of February, 2026. 7. This interlocutory application is accordingly disposed of.
