Rakesh Kainthla, Judge The petitioner has filed the present petition for quashing of FIR No. 116 of 2018, dated 26.6.2018, registered for the commission of offences punishable under Sections 323, 498 A, and 506 of the Indian Penal Code (IPC) at Police Station Dhalli, District Shimla, H.P. and the consequent proceedings 1 Whether reporters of Local Papers may be allowed to see the judgment? Yes. 2025:HHC:34089 arising out of the FIR based on the compromise effected between the parties. 2. It has been asserted that the parties have entered into a compromise after the registration of the FIR, and the informant/victim does not want to proceed further with the matter because of the compromise. 3. Statement of the informant/victim was recorded on 20.8.2025, in which she stated that the accused is her husband. She and the accused have been residing together for one year as per the compromise, and she did not want to proceed further because of the compromise. 4. I have heard learned counsel for the parties and have gone through the records carefully. 5. Offences punishable under Sections 323 and 506 of IPC are compoundable under Section 320 of Cr.P.C., and the FIR registered for the commission of an offence punishable under Section 498-A can be quashed based on the compromise as per the judgments in Gian Singh versus State, 2012 (10) SCC 303, Narender versus State of Punjab, 2014 (16) SCC 466, Vikas Singh vs. State of H.P.(2023)I DMC 335 (HP) and Sanjay Kumar vs. State of H.P2023 (1) Him L.R. 602, which are binding upon this Court. 2025:HHC:34089

Consequently, the present petition is allowed and the FIR No. 116 of 2018, dated 26.6.2018, registered for the commission of offences punishable under Sections 498-A, 506 and 323 of the Indian Penal Code (IPC) at Police Station Dhalli, District Shimla, H.P. is quashed and consequent proceedings pending/initiated against the petitioners-accused in pursuance thereto, are also quashed. 7.
Petition stands disposed of in the above terms, so also pending miscellaneous applications, if any. 8. Parties are permitted to produce a copy of this judgment, downloaded from the webpage of the High Court of Himachal Pradesh, before the authorities concerned, and the said authorities shall not insist on the production of a certified copy, but if required, may verify passing of the order from the Website of the High Court.
