1. Heard Mr. Shivank Mishra, learned counsel for the applicant. Also heard Mr. Malay Jain, learned Panel Lawyer, appearing for the non- applicant/State.

2 application has been filed against the order of cancellation of the bail application to the applicant dated 30.04.2025.

Learned counsel for the applicant relies on the judgment passed by the Hon’ble Supreme Court in the matter of Vipin Kumar vs. State of U.P. in CRA No. 726 of 2025 (arising out of SLP(Crl.) No. 17918 of 2024) for filing of the present bail application without filing the bail application before the trial Court. He further submits that in compliance of the order dated 30.04.2025, applicant has not surrendered before the concerned Police Station to which, learned State counsel submits that if the applicant has not surrendered before the concerend Police Station, hence, the present bail application is not maintainable.
4. The case law relied upon by the learned counsel for the applicant is of no help to the application as the same distinguishable from the facts of the present case.
5. In view of the above, the present bail application is dismissed with a liberty to the applicant to file a fresh bail application, if further cause of action arises. Sd/- (Ramesh Sinha)
