JUSTICE MAHENDAR KUMAR GOYAL Order 20/08/2025 This writ petition is directed against the order dated 02.07.2014 passed by the respondent no.2 whereby, services of the petitioner were terminated as he did not possess the requisite educational qualification. The relevant facts in brief are that pursuant to advertisement no.219/2009-10 and 152/2010-11 issued by the respondent- corporation, the petitioner was selected and appointed as driver vide order dated 09.11.2011. His services were terminated vide order impugned on the premise that his adeeb qualification from ‘Jamia Urdu Aligarh’ is not equivalent to secondary examination conducted by the Board of Secondary Education, Ajmer. However, learned counsels for the respective parties agree that this issue is [2025:RJ-JP:32811] (2 of 2) [CW-7779/2014] no more res integra and has been resolved by this Court in terms that the adeeb qualification of Jamia Urdu Aligarh is equivalent to secondary examination conducted by the Board of Secondary Education, Rajasthan in the case of Jahida Salma vs. State of Rajasthan and Others: S.B. Civil Writ Petition No.1457/2021 and other connected batch of writ petitions vide judgement dated 10.02.2022. In view of the aforesaid admitted legal position, the order dated 02.07.2014 is not found sustainable in the eye of law. Resultantly, this writ petition is allowed.
