This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 152/2025 registered at Police Station – Mahasamund, District - Mahasamund (C.G.) for the offence punishable under Section 34(2), 42 of the Chhattisgarh Excise Act, 1915 under Section 78 of Juvenile Justice (Care and Protection of Children) Act, 2015 & under Section 111 & 95 of BNS, 2023. 2. It transpires from the record that the present anticipatory bail application falls under Section 34(2) and 42 of the Chhattisgarh 2 Excise Act. which is not maintainable as per provisions of Section 59(A)(i) of the Chhattisgarh Excise Act. 3.
