Kunjaraj, learned counsel appeared for the petitioner; Mr. Shyam Sharma, learned GA and Mr. S. Jasobanta, learned counsel appeared for the respondents. This matter was referred for mediation by this Court and after process of mediation, the report has been submitted by the Mediator stating that the dispute between the parties have amicably settled. The report submitted by the Mediator are as under :-
“ Nature of Dispute: Refund of Gratuity Amount. Mediation session was conducted on 12-08-2025, 18-08- 2025, 03-09-2025 & 14-10-2025. The parties were given full opportunity to present their issues and explore settlement possibilities. Page 2 i. The said Gratuity amount of Rs. 900,000/- (Rupees Nine Lakhs Only) was already received by the petitioner who is the wife of the late government employee W. Tomba Singh who was serving in the Police Department, CID (SB), (the said amount was deposited in the account bearing No. 20408126954 of the petitioner operating in the SBI, Secretariat Branch). The relevant document was produced by the Department concerned. ii. The said amount claimed to be deducted from the late husband’s retirement Gratuity account had already been deposited to the petitioner’s account and she received the same, the prayer in the present Writ Petition become infructuous and the writ petition may be disposed of on that ground.” As the matter has already been settled between the parties, the counsel appearing for the parties submitted that the present writ petition can be disposed of in terms of the settlement as quoted herein above. Recording the submission made by the counsel appearing for the parties, the present writ petition is hereby closed. JUDGE Dhakeshori
