[2025:RJ-JP:32268] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 8152/2025 Rajveer Gurjar S/o Shri Rajpaal Gurjar, Aged About 28 Years, R/o Akbarpur, Police Station Shrimahaveerji, District Karauli, Rajasthan (Accused Petitioner Is In Sub Jail Karauli) ----Petitioner Versus State Of Rajasthan, Through P.P. ----Respondent For Petitioner(s) : Mr. Amitabh Vijaywargia For Respondent(s) : Mr. Shree Ram Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 18/08/2025 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No.544/2024 registered at Police Station Pratap Nagar (Jaipur City, East), District Jaipur City (East) for the offence(s) under Section 8/21 of NDPS Act. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case for the offence under Section 8/29 of NDPS Act, solely on the basis of disclosure statement of the other co-accused, from whom, 7 gms of smack was recovered. There is no substantive piece of evidence available on record indicating the fact that the petitioner has supplied the said smack to the other co-accused. The call details cannot connect the petitioner in the alleged offence. The charge- sheet against the petitioner has already been produced. The [2025:RJ-JP:32268] (2 of 3) [CRLMB-8152/2025] accused-petitioner is in custody since 16.06.2025 and trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the bail application and contended that the accused-petitioner in connivance with the other co-accused supplied the smack and the call details transpired between the petitioner and the other co- accused validate this fact. Further, the petitioner is having criminal antecedents and against him, 4 cases out of which 1 case of similar nature of offence was registered, therefore, the bail application of the accused-petitioner may be dismissed. 4. Heard and perused the material available on record. 5. Considering the argument advanced by learned counsel for the petitioner and looking to the fact that the accused-petitioner is in custody since 16.06.2025 and trial of the case may take considerable time, I deem it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Rajveer Gurjar S/o Shri Rajpaal Gurjar, in connection with FIR No.544/2024 registered at Police Station Pratap Nagar (Jaipur City, East), District Jaipur City (East), shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so. [2025:RJ-JP:32268] (3 of 3) [CRLMB-8152/2025] 7. The accused-petitioner is also directed to mark his presence on 25th of every month till conclusion of trial before the concerned police station. The SHO of the concerned police station is directed to maintain a regular register marking the presence of the accused-petitioner and shall send the presence report of the accused-petitioner on the same day to the concerned Trial Court without any delay. In case of any breach to the above condition, the learned Public Prosecutor shall be free to move the application against the petitioner for cancellation of the bail before the concerned Court.
