Nath, learned counsel for the applicant/ petitioner, who submits that the State respondents should be directed to release the provisional pension of the applicant/ petitioner w.e.f. 01.02.2024 to 31.01.2025. He submits that provisional pension has not been given to her till date. 2. Mr. B.Choudhury, learned counsel for the BTC submits that the provisional Page No.# 3/4 pension of Rs.39,000/- in favour of the applicant/petitioner has been made w.e.f. 01.02.2024 to 31.01.2025. In this regard, he has submitted an order dated 11.09.2024 issued by the Director of Education, BTC, Kokrajhar, which states as follows: “No.DE/BTC/Pen-336/Pt-I/Sec/Chirang/2015/123,In pursuance of Govt. letter No. PPG (P)-43/88/11, dtd.30-5-1988 and as per Rules 135 (3) of A.S. (P) Rules, 1969 the Provisional Pension of Rs.39,000.00 (Rupees thirty nine thousand) p.m. only is hereby extended to Smti. Bula Sarkar, Retd. Subject Teacher Bijni Bandhab H.S.School for another period of 1(one) year w.e.f. 01-02-2024 to 31.01.2025, who retired from service on 31.01.2022. Dearness relief and medical allowances will be admissible as per rule. The Provisional Pension is subject to the adjustment from the Final Pension which will be authorized by the Director of Pension and Accountant General, Assam. The said amount is debit able under the Head of Account “2071- Pension and other retirement benefit.” The above order dated 11.09.2024 has been issued vide Memo No.DE/BTC/Pen-336/Pt-I/Sec/Chirang/2015/123. 3. In view of submission made by Mr.B.Choudhury, learned counsel for the BTC and the order dated 11.09.2024, the respondent Nos. 6 and 7 are directed to release the provisional pension of Rs.39,000/- to the applicant/petitioner, Page No.# 4/4 within a period of two weeks from the date of receipt of a copy of this order. 4.
