Monomala, learned G.A. appearing for the respondents, submitted before this Court that the present writ petition has been filed with a prayer for issuing a direction to the respondents to implement the official letter dated 22.06.2022 (Annexure A/6 to the present writ petition) in the matter of completion of DPC for promotion to the post of Associate Professor in the Department of Pediatric and Preventive Dentistry in Dental College, JNIMS. It has been submitted by the learned G.A. that during the pendency of the present petition, the respondents have already held a DPC on 31.12.2024 and on the recommendation of the said DPC, one Dr. Naorem Nena Devi, Associate Professor, has been appointed and promoted to the post of Associate Professor, Paediatric & Preventive Dentistry, Dental College, JNIMS by issuing an order dated 10.01.2025. The learned G.A., submitted that in view of the subsequent events and issuance of the said order dated 10.01.2025, no cause survives for adjudication in the present writ petition and accordingly, the present writ petition can be closed as infructuous. Tarunkumar, learned senior counsel, who have filed an application being MC(WP(C)) No. 128 of 2023 for impleading the applicant as respondents in the connected writ petition, that the aforesaid promotion order dated 10.01.2025 has been challenged by the present writ petitioner by filing a writ petition being WP(C) No. 46 of 2025 before this Court and as such, the present writ petition can be closed as infructuous. Ms. Deepika, learned counsel appearing for the petitioner, fairly submitted that any appropriate order as deem fit and proper may be passed. In view of the submission made by the learned counsel appearing for the parties and on careful perusal of the record, this Court is satisfied that no cause survives for adjudication in the present writ petition due to the subsequent event that happened and as such, the present writ petition is hereby closed as infructuous.
