Perme, learned counsel for the respondent no. 1 as well as Shri M. Kato, learned Dy. S.G.I. for the Union of India. Shri R. Dubey, learned counsel is present for the Airport Authority of India. Shri Ratan, learned Addl. A.G. by drawing the attention of this Court to the averments made in paragraphs 4 and 5 has submitted that due to compelling Page No.# 3/3 reasons which were beyond the control of the applicant, the delay has occasioned. The learned counsel for the respondents have not seriously objected to the prayer for condonation of delay. Shri Perme, learned counsel has, however, submitted that he would contest the appeal on merits. The law on the subject of condonation of delay is settled by a catena of decisions of the Hon’ble Supreme Court wherein, it has been laid down that a pragmatic and justice oriented approach should be taken. We have also taken into consideration the grounds put forward and also the fact that the delay is not an inordinate one. Considering the above, the delay is condoned. The I.A. accordingly stands allowed. The registry is directed to register the appeal and list the same for admission hearing. JUDGE JUDGE Comparing Assistant
