JUSTICE ROBIN PHUKAN ORDER 18.03.2026 Heard Mr. P. Surien, learned counsel for the petitioner and Mr. N. Ratan, learned Additional Advocate General for the respondent authorities. During the course of deliberation, Mr. Surien, learned counsel for the petitioner submits that the petitioner has been suspended and he has not been paid salary. However, to a pointed query of this Court, Mr. Surien submits that the suspension order is not impugned in this writ petition. Mr. Ratan, learned Additional Advocate General for the respondent authorities, producing the Suspension Order, dated 12.08.2025, submits that before filing of this petition, the petitioner was placed under suspension, for not joining his duties in the new place of posting and as such, the petitioner may be directed to withdraw this petition and to approach this Court again, by filing appropriate petition. Mr. Surien, learned counsel for the petitioner also submits that he may be allowed to withdraw this petition, by granting him liberty to approach this Court again, by filing appropriate petition. Accordingly, taking note of the submission of the learned counsel for both the parties, Mr. Surien is permitted to withdraw this petition and this writ petition stands disposed of, on withdrawal. However, liberty will remain with the petitioner to approach this Court again, by filing appropriate petition.
