2 Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail to the applicant who has been apprehended his arrest in connection with Crime No. 30/2017 registered at Police Station Kapu, District – Raigarh (C.G.), for the offence punishable under Section 376 of I.P.C. and 4 & 12 of POCSO Act.
2. The earlier bail application of the applicant bearing MCRCA No. 1002 of 2017 and MCRCA No. 467 of 2019 have been rejected by this court on 03.01.2018 and 26.04.2019 respectively.
3. The prosecution's case is that the prosecutrix was working as maid in the house of the applicant and the applicant lured the prosecutrix and sexually harassed her.
4. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case because the prosecutrix herself has stated in her statement under Section 164 of Cr.P.C. that she had an affair with the applicant. Therefore, the allegations are exaggerated.
5. On the other hand, learned counsel for the State opposes the prayer and submits that the earlier bail application bearing MCRCA No. 1002 of 2017 and MCRCA No. 467 of 2019 has already been rejected by this Court and at the time of alleged
3 commission of offence the prosecutrix was only 15 years old.
6. I have heard learned counsel appearing for the parties and perused the case diary.
7. Considering the facts and circumstances of the case,
submissions of learned counsel for the parties, further considering the facts that the earlier bail applications bearing MCRCA No. 1002 of 2017 and MCRCA No. 467 of 2019 have been rejected on 03.01.2018 and 26.04.2019 respectively. Further, as the learned counsel for the applicant cannot bring any new ground to interfere in the matter , thus the third bail application is also rejected.
8. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith.
