Tarlok Singh Chauhan, Judge (Oral) It is extremely heartening to note that with the sincere efforts made by the learned Mediator Shri S. C. Sharma, 2 2025:HHC:1840 Senior Advocate, the parties have been able to settle their disputes. 2. The terms of the settlement are recorded in paras 2 to 4 of the Mediation Report, which read as under:- 2. Both the parties have amicably resolved their issues and have decided to live together under one roof. It is stated by the parties that the first party Smt. Aarti Rana (wife) resume the matrimonial ties with the respondent-Shri Gaurav Rana (husband) and the respondent-Shri Gaurav Rana have endorsed the same. It is stated by both the parties that they want to live peacefully together under one roof alongwith their children master Yuv Raj Rana and Kumari Garima Rana. It is also stated by Smt. Aarti Rana that Kumari Garima Rana has to take her 8th standard Examination which is likely to commence in the month of March, 2025. It is stated by Shri Gaurav Rana that he alongwith his parents and master Yuv Raj Rana will go to their native place situated at Bani, District Kangra, H.P., and at Bani they will be living with Smt Aarti Rana alongwith Kumari Garima Rana. Also stated that after the declaration of result of 8th standard, the respondent-Shri Gaurav Rana has undertaken that they will take the certificate of Kumari Garima Rana and will admit her in the school of their choice situated at Shimla. H.P. 3. Both the parties have further stated that by virtue of this statement all the litigation Civil and Criminal pending between the parties have come to an end. Both the parties have also stated that they are also bound by their statements in future. Shri Dharam Pal Rana father of the respondent-Shri Gaurav Rana has also given his consent blessings for this compromise and Smt. Trimala Devi mother of the appellant Smt. Aarti Rana have also given her consent and blessings for the aforesaid compromise. Both the parties 3 2025:HHC:1840 have undertaken that they will live peacefully with themselves and will take care of all the family members. 4. Both the parties have stated that since the matter has been compromised between the parties today, therefore, they do not want to pursue their appeals i.e. F.A.O. (F.C.) No. 34 of 2023 titled Aarti Rana vs. Gaurav Rana pending before the Hon'ble High Court of H.P., against the judgment of learned Principal Judge, Family Court, Kangra at Dharamshala, District Kangra, H.P. in H.M.A. Petition No. 64- D/III/20/2015 titled Gaurav Rana vs. Aarti Rana decided on 29.09.2023, for dissolution of marriage by a decree of divorce under Section 13 (1) (ia) Part ii of the Hindu Marriage Act, 1955 AND FAO (F.C). No. 39 of 2023 titled Gaurav Rana vs. Aarti Rana pending before the Hon'ble High Court of H.P. 3. Since, the matters have now been compromised, we accordingly set aside the decree of divorce passed on 29.09.2023 by the learned Principal Judge Family Court, Kangra at Dharamshala, in HMA Petition No. 64-D/III/20/2015. 4. The mediation order dated 08.01.2025 alongwith the statements recorded vide Annexures P-5 to P-7 shall form part of the decree. 5. The appeals stand disposed of in the aforesaid terms.
