ORAL ORDER
1. Accused no.1 in Crime No.51/2025 registered by Hebbagodi Police Station, Bengaluru District, for the offences punishable under Sections 64, 76, 3(5) of BNS, 2023, is before this Court under Section 483 of BNSS, 2023, seeking regular bail.
2. Heard the learned Counsel for the parties.

FIR in Crime No.51/2025 was registered by Hebbagodi Police Station, Bengaluru District, for the aforesaid offences against the petitioner and two others based on the first information dated 06.02.2025 received from the victim girl aged about 20 years. During the course of investigation, petitioner herein who is arrayed as accused no.1 in the FIR, was arrested on 07.02.2025, and subsequently remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.323/2025 was rejected on 11.03.2025. Therefore, he is before this Court.

Learned Counsel for the petitioner submits that the accused persons as well as the victim are all students studying law. There is a delay in lodging the complaint. The incident in question allegedly has taken place after the accused had consumed alcohol. The victim was also present with them in the place where the accused persons allegedly consumed alcohol. For extraneous reasons, a false allegation is made as against the petitioner herein. Petitioner who is a student is in custody from 07.02.2025. Accordingly, he prays to allow the petition. 5. Per contra, learned HCGP has opposed the petition on the ground that investigation of the case is under progress. 6. Perusal of the material on record would go to show that the accused persons as well as the victim are students studying law. On 04.02.2025 at about 8.30 p.m., victim had met her friend Sourav who is arrayed as accused no.2 in the FIR. He allegedly took her with him and they fell down from his bike and the victim allegedly lost her consciousness and Sourav took her to his house and gave her some injection. When she woke up, she found that Sourav was consuming alcohol with his friends. When the victim girl allegedly attempted to return to

her paying guest accommodation, the accused persons did not allow her and the petitioner pushed her down to the ground and after sitting on her chest, he allegedly punched her, and thereafter inserted his finger into her private parts. In respect of the alleged incident that had taken place on the intervening night of 04.02.2025 and 05.02.2025, first information is belatedly submitted on 06.02.2025 at about 20.35 hours. Petitioner who is a student studying law is in custody from
07.02.2025. Accused nos.2 & 3 have already been enlarged on bail. Considering the aforesaid aspects of the matter, more so the nature of allegations found in the first information, I am of the opinion that the prayer made by the petitioner who is a student for grant of regular bail is required to be answered affirmatively. Accordingly, the following order:
7. The petition is allowed.
The petitioner is directed to be enlarged on bail in Crime No.51/2025 registered by Hebbagodi Police Station, Bengaluru District, for the offences punishable under Sections 64, 76, 3(5) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the

likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off. Sd/- (S VISHWAJITH SHETTY) JUDGE
