Order 12/07/2025
1. As these bail applications have been filed pertaining to the same FIR, they are being heard and decided by the instant common order.
2. These bail applications have been filed by the accused- applicants under Section 483 of the B.N.S.S, 2023 in the matter arising out of FIR No.279/2025, registered at Police Station Karni Vihar, Jaipur (West), for the offences punishable under Sections 318(4), 336(3) and 340(2) of B.N.S., 2023 and Section 3/10 of the Rajasthan Public Examination (Measures for Prevention of Unfair Means in Recruitment) Act, 2022 and Section (V)(XV) of the Public Examination (Prevention of Unfair Means) Act, 2024.
3.
Learned counsel for the accused-applicants submits that the accused-applicants have falsely been implicated in this case.
Learned counsel also submits that as per the impugned FIR, the allegation against the accused-applicants is with regard to attempt to use unfair means in the examination of NEET, 2025 by arranging dummy candidates in place of original candidates.
Learned counsel contends that the other co-accused-Rohit Gora has been enlarged on bail by learned trial Court itself and the accused-Sanjay Choudhary has been granted benefit of bail vide
order dated 09.06.2025 passed by the Coordinate Bench of this Court in S.B. Criminal Miscellaneous Bail Application No.6972/2025 and case of the present accused-applicants is not
[2025:RJ-JP:25778] (3 of 4) [CRLMB-8061/2025] different from the other co-accused persons, who have been enlarged on bail.
4.
Learned counsel for the accused-applicants argues that the accused-applicants were arrested before the said examination i.e. on 04.05.2025 and since then, the accused-applicants are behind the bars, therefore, it cannot be said that they have committed any offence for which they have been charged. Learned counsel also argues that no other criminal case has been registered against the accused-applicants and trial will take long time to conclude, therefore, the accused-applicants be granted benefit of bail.
5.
Learned counsel appearing on behalf of the State vehemently opposes these bail applications and submits the factual report dated 11.07.2025. The factual report dated 11.07.2025 is taken on record.
6. Heard learned counsel for the parties and also perused the material available on record.
7. Having regard to the facts and circumstances of the case; considering the period of custody of the accused-applicants; the fact that other co-accused persons have been enlarged on bail; no other criminal case has been registered against the accused- applicants and also considering the fact that the trial will take long time to conclude, but without expressing any opinion on the merits/demerits of the case, this Court deems it proper to allow these bail applications filed by the applicants.
8. Consequently, these bail applications filed under Section 483 of the B.N.S.S., 2023 are allowed. It is ordered that accused-
[2025:RJ-JP:25778] (4 of 4) [CRLMB-8061/2025] applicants namely (1) Sohan Lal Choudhary S/o Shri Lalaram, (2) Ajit Kumar Barala S/o Shri Bhivaram & (3) Jitendra Sharma S/o Shri Nand Kishore, arrested in connection with FIR No.279/2025, registered at Police Station Karni Vihar, Jaipur (West), will be released on bail; provided each of them furnishes personal bond in the sum of Rs.1,00,000/- each and two solvent attested sureties of Rs.50,000/- each to the satisfaction of the trial Court. Applicants will be required to appear before that Court on all dates of hearing and as and when called upon to do so.
