The petitioners are apprehending their arrest in connection with Itkhori PS Case No.35 of 2025, for offence registered under section 126(2), 115(2), 109, 329(4), 352, 351(2) (3), 3(5) of BNS, 2023, pending in court of learned Additional Chief Judicial Magistrate, Chatra. 3. Learned counsel for petitioners submits that there are case and counter case between the parties and the present case counter blast of Itkhori PS Case No.34 of 2025. She submits that Putul Yadav and Ankit Yadav were not present on the alleged place of occurrence and in spite of that they have been implicated in the case. She further submits that injury is simple in nature however petitioners have received injury which is grievous in nature and for that Itkhori PS Case No.34 of 2025 has been lodged. She submits that all the family members have been implicated in this case and petitioners have got no criminal antecedent as disclosed in paragraph no.23. 2025:JHHC:25364 2 A.B.A. No. 4771 of 2025 4. Learned State counsel opposes prayer and submits that allegation of assault is there. 5. Considering that there are case and counter case between the parties and one case has been lodged prior of the present case by the petitioners’ side and thereafter the present case has been lodged and it has been pointed out that injury is simple in nature and petitioners’ side have got no criminal antecedent as disclosed in paragraph no.23, I am inclined to grant anticipatory bail to petitioners. 6. Accordingly, petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Additional Chief Judicial Magistrate, Chatra, in connection with Itkhori PS Case No.35 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
