GP FOR HOUSING The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer: “…..to issue a writ or order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the Respondents in finalising the seniority list of Executive Engineers (graduates) without considering the validation certificates issued by the competent authority regarding the graduation qualification (B.Tech.) as illegal, arbitrary and in violation of natural justice and consequentially direct the Respondents to include the petitioners names in the Executive Engineers (graduates, B. Tech) seniority list as on date 2 of acquiring the B. Tech Degree by the petitioners and promote them to higher grade of Superintendent engineers with all consequential benefits by making it clear that the validation certificates issued by the competent authority as per the declaration by the Hon'ble Supreme Court are to be considered while preparing the seniority list of Executive engineers graduation stream and pass such other order or orders…...” 2. Heard Sri K.S.Murthy, learned counsel for the petitioners and Sri R.Kalyan Chakravarthy, learned Standing Counsel for A.P. State Housing Corporation, appearing for the 2nd respondent. 3. Learned Standing Counsel for the 2nd respondent would submit that petitioner No.1 was promoted and retired from service and petitioner No.2 is also retired on 31.05.2021, but he was not promoted as he found not eligible as per the seniority and merit. 4. Learned counsel for the petitioners would submit that recording the same, the petition may be disposed of, as the relief has become infructuous. 5. In that view, the Writ Petition is disposed of. There shall be no order as to costs.
