The writ petition has been filed praying for quashing the F.I.R. dated 13.06.2024 registered as Case Crime No.0258 of 2024 under Sections 3/5A/8 of U.P. Prevention of Cow Slaughter Act and Section 11 of Prevention of Cruelty to Animal Act at Police Station - Geeda, District- Gorakhpur. 3. Petitioner has been implicated for committing the offence under U.P. Prevention of Cow Slaughter Act. Counsel for the petitioner submits that the petitioner is the owner of the vehicle. He was not caught on the spot, however, the police is investigating the matter. 4. Learned AGA has vehemently opposed the submissions made by learned counsel for the petitioner. 5. For the reasons given in the order dated 10.7.2024 passed in Criminal Misc. Writ Petition No.7463 of 2024 (Shobit Nehra and another vs. State of UP and others), this writ petition is disposed of directing that till the cognizance is taken on the police report under Section 193(3)B.N.S.S. by the Court below, the respondents are restrained from arresting the petitioner pursuant to the impugned First Information Report, subject to his cooperation in the ongoing investigation.
