This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- “pleased to issue a Writ or direction more particularly a Writ in a nature of Mandamus declaring the illegal action of the respondents 1 to 3 resorting to dispossess the petitioners from their respective parts of the lands though the petitioners are in continuous possession and enjoyment and eligible for the assignment the land an extent of Ac. 14.00 Cents situated in Sy.No.101/1 of Annavaram Village, measuring an extent of Ac. 0.50 cents each is illegal, arbitrary and consequently direct the respondents to issue pattadar passbook title deed in respect of the subject matter of the property an extent of Ac. 14.00 Cents Land situated in Sy.No.101/1 of Annavaram Village, Measuring an extent of Ac.0.50 cents each forthwith and pass.... 2. Heard learned counsel for the petitioners and learned Government I t Pleader for Revenue for the respondents. 3. Daring hearing, learned counsel for the petitioners, without touching the merits of the case, requested this Court to issue a direction to the respondents not to interfere with the peaceful possession and enjoyment of the subject property of the petitioners without following due process of law. 3 Learned Government Pleader for Revenue submits that, if the 4. petitioners are in possession of the subject property, the respondents would follow due process of law and requested to pass appropriate orders. When the petitioners are in settled possession and enjoyment of the property, the petitioners cannot be dispossessed, without following due process of law in view of the law declared by the Apex Court in “Rame Gowda (dead) by L.Rs. v. M.Varadappa Naidu (Dead) by L.Rs.' ”. Therefore, if the petitioners are in long standing possession of the subject property, the respondents are directed not to interfere with the peaceful possession and enjoyment of the subject property of the petitioners, except by due process of 5. law. With the above direction, the writ petition is disposed of at the stage of 6. admission with the consent of both the counsel. No costs.
