Neutral Citation No. - 2025:AHC:50866-DB Court No. - 29 Case :- WRIT - C No. - 5695 of 2025 Petitioner :- Amar Singh Kushwaha Respondent :- Baroda Up Bank And 2 Others Counsel for Petitioner :- Archana Singh,Prem Shankar Kushwaha Counsel for Respondent :- Gyan Prakash Shrivastava Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. This petition has been filed with the prayer to direct the respondents to refund the amount of bank-draft dated 24.3.2003 of Rs.5 lakhs along with interest. It appears that the bank-draft was got prepared by the late wife of the petitioner and was presented to Nagar Nigam, Prayagraj. The bank-draft has been returned by Nagar Nigam some time in the year 2022. It is thereafter that petitioner has approached the bank for refund of the amount. Sri G.P. Shrivastava, learned counsel appearing for the Bank, states that procedural formalities as are required under the standard procedure have not been followed by the petitioner and since the petitioner is not having any account in the bank, it is not possible to process the request. Counsel for the petitioner states that the petitioner has been running from pillar to post, but the bank has not cared to process his request. In that view of the matter, we dispose of this writ petition with a direction upon the respondent-bank to provide information with regard to the procedures to be followed by petitioner for the refund of the amount. Such procedure will be indicated to the petitioner within a week from the service of a copy of this order upon the respondent-bank. The petitioner shall do the needful as is required under the standard operating procedure, whereafter the bank shall do the needful without further loss of time preferably within a period of four weeks, thereafter.
