HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 46/2025 Gaurav Singh Rathore S/o Late Shri Sardar Singh, Aged About 33 Years, R/o House No. 13/239, Kaveri Path, Near Amit Bal Vidya Mandir School, Police Station Mansarovar, Jaipur. At Present Assistant Administrative Officer At Human Organ Transplant Department, Sawai Man Singh Hospital, Jaipur. (Presently Accused Confined In Central Jail Jaipur). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Harendra Singh Mr. Shivam For Respondent(s) : Mr. Rajesh Choudhary, GA-cum-AAG HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 21/01/2025 1. The instant bail application has been filed under Section 483 B.N.S.S. on behalf of the accused-petitioner. The accused- petitioner has been arrested in connection with FIR No.104/2024 registered at Police Station SMS Hospital, District Jaipur City (East) for the offence(s) under Sections 420, 465, 467, 468 and 471 of IPC. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that similar nature of cases were registered against the accused-petitioner and the police went upon to implicate him in the same matters for which the FIR has already been registered. It is also contended that in the FIR, the accused- petitioner has already been enlarged on bail by this Court as well as by the co-ordinate Bench of this Court. The accused-petitioner is in custody since 03.12.2024 and trial/investigation of the case (2 of 2) [CRLMB-46/2025] will take considerable time, the bail may be granted to the accused-petitioner. 3. Learned GA-cum-AAG vehemently opposed the bail application and contended that the accused-petitioner was found to be involved in issuance of fake NOC for permitting human organ transplantation, therefore, the bail application of the accused- petitioner deserves to be dismissed. 4. Heard and perused the material available on record. 5. Considering the arguments advanced by the counsel for the parties and looking to the fact that in similar nature of cases, the accused-petitioner has already been enlarged on bail and the accused-petitioner is in custody since long, charge-sheet has already been produced before the concerned Court and the trial/investigation will take considerable time, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, this bail application under Section 483 B.N.S.S. is allowed and it is ordered that the accused-petitioner Gaurav Singh Rathore S/o Late Shri Sardar Singh in connection with FIR No.104/2024 registered at Police Station SMS Hospital, District Jaipur City (East), shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
