1. Aggrieved by the order dated 19.03.2025 issued by the Panchayat Samiti, Deoli, Tonk, the petitioner has approached this Court by way of filing this writ petition. 2. Counsel for the petitioner submits that the shop in question was allotted to the petitioner in the year 2009 and at the relevant time, the petitioner was not in Government service. Counsel submits that the petitioner got Government service in the year 2012 and thereafter, an application was submitted by him before the authorities to transfer the allotment of the shop in favour of his son, but without deciding the said application submitted by the petitioner, the respondents have cancelled the allotment and issued directions to handover the vacated possession of the same
(2 of 2) [CW-9922/2025] to the respondents. Counsel submits that the respondents were supposed to decide the application submitted by the petitioner, but instead of doing so, they have straightaway passed the order impugned, hence, interference of this Court is warranted. 3. Heard and considered the submissions made at Bar and perused the material available on the record. 4. Perusal of the record indicates that neither such application has been placed on the record and no such averment has been made in the pleadings of the instant writ petition, hence, it cannot be pleaded at this stage that at any point of time, the petitioner requested the respondent-authorities to transfer the allotment of the shop in question in favour of his son. In absence of such pleading or argument, no such direction can be issued by this Court. 5. The instant writ petition stands disposed of with the expectation from the respondents that in case, any application has been submitted by the petitioner for the aforesaid purpose and the same is lying pending and not decided as yet, the same be decided strictly in accordance with law. 6.
The stay application and all pending applications, if any, also stand disposed of. (ANOOP KUMAR DHAND),J KuD/21
