By way of this petition filed under Article 227 of the Constitution of India, the petitioners have assailed the order dated 09.09.2024, passed by the learned Civil Judge (II), Amb, District Una, whereby an application filed by the petitioners herein under order XXVI, Rule 9 of the Code of Civil Procedure has been dismissed by the learned Court below.

When the case was taken up for consideration, learned Counsel for the petitioners submitted that during the pendency of the suit, the disputed land alongwith some other land, has been demarcated by the HPPWD and report of the said demarcation is likely to come very shortly and the petitioners be allowed to place

said demarcation report on the record of the learned Trial Court. This Court is of the considered view that as far as placing on record the said demarcation report is concerned, the petitioners or any other party, can always do so, in accordance with law, if permissible in law and for that, no express permission of this Court is required.

Accordingly, these proceedings are closed by vacating the interim order dated 03.10.2023 and with the observation that in case, any application is filed by any of the parties, to place on record the demarcation report, which has been carried out by the public authority(ies), then appropriate orders thereupon be passed by the Court concerned, in accordance with law. Pending miscellaneous application(s), if any also stand disposed of accordingly.
