Petitioners submit that they have been falsely implicated and they are the victim of police overaction and atrocities and without committing any offence whatsoever, they have been languishing in judicial custody. Petitioners further contention is that they have been intercepted from Rathbari Bus stand and in accordance with plan, the case was made out and seizure list forwarding report, FIR etc. were prepared by one S.I. of Police and has registered the present case and that nothing was recovered from their possession and the police has hatched up a criminal conspiracy and implanted some narcotic articles showing the alleged recovery and seizure at the instance of the petitioner and no videography was done. Learned counsel for the State opposed the prayer for bail contending that commercial quantity of narcotic substance was recovered from the possession of the present
2 petitioners and that the petitioners are the resident of Bhagalpur and if they are released on bail, there is serious chance of his abscondance. Having considered the submissions made on behalf of both the parties and that rigour of Section 37 of the NDPS Act clearly attracts in the present case against the present petitioners and as such, the prayer for bail is rejected. Accordingly, CRM (NDPS) 531 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
