03/ 14.08.2025 Heard learned counsel appearing for the petitioner and learned A.P.P. for the State.

The petitioner is apprehending his arrest in connection with Sidhgora P.S. Case No. 189 of 2024, registered for the alleged offence under Sections 108, 61(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the Court of learned Judicial Magistrate, 1st Class, Jamshedpur.

Learned counsel appearing for the petitioner submits that the mother-in-law of the deceased has already been provided the privilege of anticipatory bail in A.B.A. No. 2153 of 2025 and the husband, who was in custody and he has also been granted regular bail by the co-ordinate benches of this court. He submits that the petitioner happened to be the brother-in-law of the deceased and the allegation is made of instigation for committing suicide to the deceased.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegation is there of instigation, pursuant to that the suicide has been committed by the deceased.

Considering that in the identical situation, the mother-in- law has already been provided the privilege of anticipatory bail in

A.B.A. No. 2153 of 2025 by the co-ordinate bench and the same allegation is there against the petitioner, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner, named above, is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner, named above, shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty-five thousand), with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Jamshedpur, in connection with Sidhgora P.S. Case No. 189 of 2024, subject to conditions as laid down under Section 482(2) of the Bharatiya Nyaya Sanhita, 2023.
