Hon'ble Shri Justice Ravindra Kumar Agrawal Order on Board 18-08-2025 1. The petitioner has filed the present writ petition claiming following relief(s):- “i. That, this Hon’ble Court may kindly be pleased issue writ in the nature of mandamus directing the respondents to grant pension to Digitally signed by MOHAMMAD AADIL KHAN 2 the petitioner from the date of superannuation i.e., 31.03.2022. ii. That, this Hon’ble Court may kindly be pleased issue writ in the nature of mandamus directing the respondents to decide the representation (Annexure P/5) and grant pension to the petitioner, from the dat of superannuation i.e., 31.03.2022 within stipulated time as prescribed by the Hon’ble Court. Iii. Any other relief, which this Hon’ble Court deems fit and proper, may also kindly be granted to the petitioner, in the interest of justice.” 2. Learned counsel for the petitioner would restrict her submission that the petitioner has been retired from service vide order dated 07-03-2022 and till date his pensionary benefit has not been extended to him and his pension has not been fixed. She would submit that service of the petitioner was pensionar and necessary funds was to be sanctioned by the State Government. The petitioner has moved his representation dated 29-04-2025 for grant of pension, but till date his representation has not been considered by the authorities concerned and therefore, respondents No.3 to 5 may be directed to decide the pending representation of the petitioner in accordance with law within a stipulated time-frame. 3. On the other hand, learned counsel for the State has submitted that they have no objection if such a direction is made to the authorities concerned to decide the pending representation of the petitioner within a stipulated time in accordance with law . 4. I have heard learned counsel for the parties and perused the material annexed with the petition. 5. Considering the submissions made by learned counsel for the parties, considering the issue involved in the present writ petition, the present writ petition is disposed of directing respondents No.3 to 5 to take a decision on the pending representation of the petitioner dated 29-04-2025 3 (Annexure-P/5) within four months from the date of receipt of copy of this order, in accordance with law and as per the applicable rules and circulars after verifying the service record of the petitioner. 6. The petitioner is directed to produce a copy of this order within two weeks from today to the respondents No.3 to 5. 7. With the aforesaid observation, the present writ petition is disposed of.
