Neutral Citation No. - 2025:AHC:50394-DB Court No. - 29 Case :- WRIT - C No. - 5504 of 2025 Petitioner :- Manawwar @ Mannu And 3 Others Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Indra Bahadur Yadav Counsel for Respondent :- C.S.C. Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. Following orders were passed on 24.03.2025: "Heard learned counsel for the parties. Despite the orders passed on 24.02.2025 and 10.03.2025, instructions of the State are still awaited. Grievance in the writ petition is with regard to the persons kept as bonded labourers at particular brick-kiln. This is a case where allegation is that the liberty of certain persons are being curtailed and they are being forced to work as bonded labourers. It is unfortunate that despite repeated orders passed by this Court and communication sent to the office of the District Magistrate, Baghpat, neither anyone is responding nor instructions are being furnished. In that view of the matter, we are forced to summon the District Magistrate, Baghpat to appear before this Court on the next date fixed, failing which the Court shall be compelled to proceed further in accordance with law. Post as fresh, once again, on 08.04.2025. The liberty stands reserved to the 2nd respondent to inform the Court if grievance of the petitioner is redressed, by the next date fixed, in which event the officer may not appear personally but his affidavit would suffice." District Magistrate, Baghpat has filed her personal affidavit stating that officials of the Labour Department were directed to inspect the premises so as to examine the grievance raised in the present petition. Joint inspection report has been submitted in which none of the alleged bonded labourers were found working at the brick kiln. On telephonic information, these petitioners have informed that they have reached their home. The authorities were further informed that there is a dispute with regard to denial of wages to these petitioners, in respect of which, appropriate proceedings have been initiated. In view of the specific stand of the District Magistrate based upon the joint inspection of the State officials, according to which, none of the alleged persons are being forced to work as bonded labourers, no further directions are required to be issued in this case. So far as the dispute of wages is concerned, we hope and trust that the competent authorities shall examine such claim after notice to the aggrieved persons, expeditiously. The writ petition is, accordingly, disposed of. Order Date :- 8.4.2025 Noman Digitally signed by :- NOMAN AHMAD High Court of Judicature at Allahabad
