Neutral Citation No. - 2025:AHC:26023 Court No. - 5 Case :- WRIT - A No. - 2377 of 2025 Petitioner :- Shivakant Mishra Respondent :- Union Of India And 2 Others Counsel for Petitioner :- Shyam Sunder Maurya Counsel for Respondent :- A.S.G.I.,Dinesh Kumar Rai,Sudarshan Singh Hon'ble Ajay Bhanot,J. Heard Shri Shyam Sunder Maurya, learned counsel for the petitioner, Shri Santosh Kumar Upadhyay, learned counsel holding brief of Shri Dinesh Kumar Rai, learned counsel for the respondent nos. 2 and 3 and Shri Sudarshan Singh,
learned counsel for the Union of India. The petitioner claims that various service benefits including Privilege Leave Encashment, LTC and P.F. have not been paid to the petitioner. He has made a representation in this regard but to no avail. The only prayer made on behalf of the petitioner is that his representation may be decided within a stipulated period of time. Shri Santosh Kumar Upadhyay, learned counsel holding brief of Shri Dinesh Kumar Rai, learned counsel for the respondent nos. 2 and 3 and Shri Sudarshan Singh, learned counsel for the Union of India submit that the matter requires determination of facts by the competent authority
as per law in the first instance. However, they fairly contend that service benefits/claim is liable to be decided by the competent authority in a reasonable time frame. In light of the aforesaid submissions and without going into the merits of the case, the respondent no. 3 is directed to decide the representation of the petitioner for disbursal of various service benefits including Privilege Leave Encashment, LTC and P.F. as per law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. With the aforesaid direction, the writ petition is finally
disposed of.
