The Suit No. 23 of 1996 filed by petitioner was decreed on 26.05.2006. According to para no. 6 of writ petition, against the said judgment and decree, no civil appeal was preferred by defendant. An Execution Case No. 7 of 2007 was filed by decree holder/petitioner, which is pending consideration before Civil Judge (Senior Division), FTC, District Jalaun at Orai. The sole prayer made in the writ petition is for expeditious disposal of Execution Case No. 7 of 2007. 3. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon executing court to decide the Execution Case No. 7 of 2007, in accordance with law, after hearing all affected parties, preferably within a period of four months from the date of production of certified copy of this order. 4. With the aforesaid directions, writ petition stands disposed of. 5. It is made clear that this Court has not adjudicated the matter on merits.
