Heard Mr. M. Z. Shah, learned counsel appearing for the accused petitioners as well as Mr. D. Das, learned Addl. P.P., Assam appearing for the State respondent. By filing this petition under Section 483 of the BNSS, 2023 the accused- petitioners, namely, (1) Harindra Chauhan (2) Manoj Chauhan (3) Chotelal Chauhan, have prayed for grant of bail in connection with Kheroni P.S. Case No.55/2024 under Sections 103/3(5) of BNS. On 08.10.2024, the deceased, Binod Chauhan went out to home to collect the ideal of goddess Durga, next day his dead body was discovered in a railway track. The case diary reveals that present three petitioners have mercilessly bitten Binod Chauhan and tried to show that he had committed suicide and his body was thrown in a railway track then the incoming train ran over the body of Binod Chouhan. I have considered the submission of learned counsel for both the parties. At this stage the petitioners did not deserve to be released on bail. The investigation is going on. Therefore, this Court is of the opinion that it is not a fit case to grant the privilege of pre-arrest bail to the petitioner.
Page No.# 3/3 Therefore, the bail application stands rejected. Return the case diary. This disposes of the bail application.
