Heard learned counsel for the petitioner and Sri Sahil Srivastava, learned counsel appearing on behalf of the respondent- Bank. 2. Counsel appearing on behalf of the petitioner has come with a demand draft/bank draft for a sum of Rs. 5 lacs payable to the respondent no.3. 3. Counsel appearing on behalf of the respondent no.3 submits that the finance company is willing to take the balance amount in easy installments and would provide a statement of account to the petitioner within a week from date indicating the balance amount due. 4. In light of the same, we are of the view that the following order may be passed:- (i) The balance amount shall be paid by the petitioner in four equal monthly installments starting from July, 2025. (ii) No recovery charges shall be taken from the petitioner by the respondent authorities. (iii) Till the period prescribed for depositing the aforesaid amount, no recovery proceedings shall be initiated against the petitioner and in case already initiated, the same will be kept in abeyance. In case the petitioner defaults in depositing the installments within the stipulated period, it will be open for the respondents to start recovery proceedings against the petitioner. 5.
